TRADE NOTICE NO. 12/2003


Sub:- New Central Excise Registration Procedure for Powerloom Weavers /  Hand Processors / Dealers of Yarns and Fabrics / Manufacturers  of Ready Made Garments - reg.

          In the recent changes in the budget 2003-2004 after the withdrawal of deemed credit and removal of SSI exemptions on textiles and textile articles, a large number of Powerloom Weavers / Hand Processors/ Dealers of Yarns and Fabrics/ Manufacturers of Ready Made Garments are now required to be registered with the Central Excise. A simple registration process has been prescribed for such units.

 2.                 In view of the fact that the new registrant may not be familiar with the central excise procedure, Trade Associations are requested to facilitate the Registration process by collecting the applications for Registration of their members and hand it over to Commissionerate Headquarter (Technical Branch), where the registration would be issued  by a special cell constituted for the purpose. Penal action on account of clearances of the specified readymade garment  units for home consumption on payment of duty pending grant of registration will not be initiated for the time being.

 3.                 Attention is also invited to Notification No.38/2003-C.E (NT) dated 22.4.2003 in which a simpler application form has been introduced exclusively for registration of Powerloom weavers/Hand processors / dealer of yarns and fabrics/ manufacturers of ready made garments who are now  required to pay duty or follow Central Excise procedure on account of changes in the Finance Bill, 2003-2004. In comparison to existing Registration application form, this format seeks information of paramount importance only from the registrant. It is clarified that the said Registration Form-1A (Copy enclosed) shall be used for new registration in the Textile and Textile Sector only. Those who are already registered need not apply afresh. Though the present instructions require the submission of the application form and grant of registration in the Central Excise Division office, the stipulation that the Registration Form may be handed over by Trade and Industry in the special cell,  Commissionerate Hqrs. (Technical Branch) shall continue  as an option. Registration will be given in the absence of PAN, if not available and the verification of the premises may not be conducted at this juncture for grant of registration.

 4.                 All officers have been instructed to extend maximum co-operation to trade in grant of Registration and to educate them in respect of  this new Central Excise procedure.

5.                 All the Trade Associations are requested to give wide publicity to this Trade Notice amongst their members / constituents.
